When a construction worker was killed in a fall from scaffolding, surviving loved ones turned to Riddle & Brantley’s North Carolina workers’ compensation lawyers to seek justice. The parties subsequently had a hearing in front of the Deputy Commissioner of the North Carolina Industrial Commission to determine proper beneficiaries and benefits. The plaintiff was not survived by any spouse or children or other dependents but had one surviving next of kin who was a citizen and resident of a foreign country. Our attorneys were able to put on documentary and affidavit evidence and witness testimony to support the relationship of next of kin.

The Deputy Commissioner found that the next of kin was entitled to 500 weeks of death benefits and ordered the defendants to pay all funeral expenses and Industrial Commission costs.

The parties subsequently resolved the claim via Consent Order for a payment of lump-sum benefits, computed to a lump-sum present value and funeral expenses and costs.
