How Do Settlements Work?
Thousands of Zantac lawsuits have been consolidated into multi-district litigation (MDL). MDLs are a legal mechanism used to consolidate similar claims in order to expedite their progress through the courts. In an MDL — unlike a class action — plaintiffs’ cases remain separate, but are typically divided into “tiers” when determining how to divide a potential “global” settlement.
Global Settlements
A “global settlement” is an agreement between a defendant and multiple plaintiffs, such as those individuals who have filed lawsuits against Zantac manufacturers like GSK and Sanofi. Global settlements usually involve extensive back-and-forth negotiations between defense and plaintiffs’ attorneys, and the amount of the settlement is often influenced by verdicts in early bellwether trials. In simple terms, the stronger the evidence supporting plaintiffs’ claims and the more significant the early verdicts are, the larger a potential global settlement will likely be — however, there are no guarantees.
Determining which global settlement “tier” a plaintiff may be assigned to typically depends upon the severity of the injury and the evidence supporting the case. Zantac claimants may qualify for different levels of Zantac payouts in any potential global settlement.
