***Disclaimer: No settlement agreement has been reached in any litigation regarding ranitidine (ZANTAC®), including in the Multidistrict Litigation in the United States District Court for the Southern District of Florida (case no. 20-MD-2924).

Potential Zantac Settlement

Potential Zantac Settlement Attorney - Riddle & BrantleyWhile no Zantac settlement has been reached as of mid-2021, legal analysts anticipate that potential Zantac settlements may be on the horizon, potentially worth millions of dollars. “Bellwether” trials — which are typically viewed as a preview for potential settlements — may begin in 2022, though trials in the Zantac multi-district litigation have yet to be formally scheduled.

Manufacturers such as Glaxo Smith Kline (GSK) and Sanofi continue to deny any wrongdoing and stand by the safety of the product. These and other Zantac manufacturers may come under pressure to settle Zantac claims, however, as lawsuit mount and juries potentially award significant damages to plaintiffs.

“How Much Can I Get from a Zantac Lawsuit?”

Potential Zantac Settlement Amount - Riddle & BrantleyIt is impossible to predict the value of a potential settlement with 100% confidence. That said, the evidence supporting Zantac cancer claims appears relatively strong, and legal analysts and plaintiffs’ attorneys predict that these cases may result in potentially significant settlements.

One attorney involved in the Zantac litigation recently observed that “Speculating at this point is not a very useful exercise,” however he noted that “If the litigation goes very well, the number I would pull out of thin air is between $150,000 and $750,000 with an average of $200,000.”

Overall, any potential Zantac settlement could be worth many millions or even billions of dollars. However, there are no guarantees and as of mid-2021, there have been no Zantac settlements.

How Do Settlements Work?

Thousands of Zantac lawsuits have been consolidated into multi-district litigation (MDL). MDLs are a legal mechanism used to consolidate similar claims in order to expedite their progress through the courts. In an MDL — unlike a class action — plaintiffs’ cases remain separate, but are typically divided into “tiers” when determining how to divide a potential “global” settlement.

Global Settlements

A “global settlement” is an agreement between a defendant and multiple plaintiffs, such as those individuals who have filed lawsuits against Zantac manufacturers like GSK and Sanofi. Global settlements usually involve extensive back-and-forth negotiations between defense and plaintiffs’ attorneys, and the amount of the settlement is often influenced by verdicts in early bellwether trials. In simple terms, the stronger the evidence supporting plaintiffs’ claims and the more significant the early verdicts are, the larger a potential global settlement will likely be — however, there are no guarantees.

Determining which global settlement “tier” a plaintiff may be assigned to typically depends upon the severity of the injury and the evidence supporting the case. Zantac claimants may qualify for different levels of Zantac payouts in any potential global settlement.

Remember, there have been no Zantac settlements as of mid-2021, and there are no guarantees that a Zantac settlement may be agreed to by defendants and plaintiffs. MDL settlements also require approval by the judge overseeing the MDL.

“Could I qualify for a potential Zantac settlement?”

The FDA has warned that Zantac is contaminated with NDMA, a potentially cancer-causing chemical and may cause as many as 20 different types of cancer. Victims meeting certain criteria may qualify for a lawsuit and be entitled to compensation in the form of a potential Zantac settlement or trial verdict.

In the aftermath of the FDA’s request that manufacturers withdraw Zantac and ranitidine from the market, Zantac claim attorneys have been filing lawsuits on behalf of those who have been diagnosed with cancer after taking Zantac or generic ranitidine.

You may qualify for a Zantac lawsuit if you meet the following criteria:

  • Used brand-name Zantac only
  • Suffered from at least one of the qualifying cancers (see below)
  • Must have used brand-name Zantac after October 1984
  • Must have used brand-name Zantac for a minimum of one year
  • Must have used brand-name Zantac once per week for a minimum of six months
