“Do I qualify for veterans benefits?”

Durham NC Veterans Benefits Lawyer - Riddle & BrantleyIf you served in active duty, inactive duty for training, or active duty for training, suffered injury or illness and were at least partially disabled, and received a discharge other than dishonorable, you may qualify for VA disability payments.

Remember, if your disabling condition was caused by injury or illness was not caused by active combat, you may still have a case for VA disability.

The VA relies on complex criteria to determine your eligibility and “VA disability rating,” which is used to help calculate the monthly payments you may be entitled to.

Roughly 30 percent of disability claims to the VA are initially denied. That doesn’t mean you don’t have a case. We have options for appealing these denials.

A veterans benefits lawyer can evaluate your case and help determine the best legal path forward.

For a FREE case review with a VA disability lawyer, please call (919) 728-1770 or complete the fast and easy online form.

There is no obligation and you won’t pay a dime in attorney fees unless we obtain VA disability benefits for you.

Please call (919) 728-1770 and let’s review your case and see if you are eligible for veterans disability benefits.

Veterans Disability Benefits Qualification Criteria

The process of applying for VA disability (or appealing a denial) can be complicated, time-consuming and stressful. The VA system is vast and complex, and in order to qualify for benefits, you must meet stringent criteria.

In order to qualify for veterans disability benefits, you must have:

  • Have served in the Uniformed Services on active duty, inactive duty for training, or active duty for training
  • Received a discharge for reasons other than dishonorable
  • Have been at least 10 percent disabled due to injury or illness suffered during your military service

Certain other criteria may also apply.

Provided you meet the above criteria, you must also:

  • Provide medical evidence (e.g. a complete medical exam) of your disability
  • Provide evidence that your disabling condition was incurred in the course of your active duty, inactive duty for training, or active duty for training service

What kind of benefits does VA disability provide?

Disability benefits from the U.S. Department of Veterans Affairs (VA) come in the form of monthly payments. These payments are based on the “disability rating” you are assigned based on your medical history and supporting evidence.

VA Disability Attorney in Durham - Riddle & BrantleyYour percentage-based disability rating (e.g. “10%,” “90%,” or “100%”) is directly connected with the amount of your monthly VA disability payment. These amounts are designated by law.

For example, a disability rating of 10% entitles you to $123 per month, while a 100% disability rating entitles you to $2,673 per month.

You may also receive a higher monthly payment if you are married and/or have dependent children.

Many factors affect your disability rating, and a veterans benefits lawyer can help.
