What can a Social Security Disability lawyer do for you?

A Social Security disability lawyer serving the Greensboro area and across North Carolina can help from the beginning to the end of your disability claim by doing things like:

  • Assisting you in filing an application for Social Security Disability benefits.
  • Walking you through your SSA file and showing you what the hundreds and hundreds of pages of employment and medical records mean to your claim.
  • Filing a Request for Reconsideration if you are denied initially.
  • Communicating with the Social Security Administration (SSA).
  • Filing a Request for a Hearing if your initial disability claim is denied.
  • Collecting treatment records from your doctors and including them in records submitted to the SSA for consideration.
  • Seeking letters and Residual Functional Capacity evaluation forms from your medical providers to support your claim for disability benefits.
  • Cross-examining witnesses at your hearing.
  • Arguing the merits of your claim to the Administrative Law Judge (ALJ).
  • Appealing your case to the federal district courts if you are denied benefits by the ALJ and Appeals Council.
  • And much more…

Has the Social Security Administration already denied your application for benefits?

The reality is that many people who apply for disability benefits on their own are turned down, sometimes multiple times.

Has this happened to you?

Most first-time applicants are denied benefits because the medical records supporting their claim are not strong or clear enough to meet the Social Security Administration’s stringent requirements to prove total disability.

Compiling the records you need to win your case can be a complicated, time-consuming and stressful process. This is where an experienced, skilled disability lawyer with experience can make the difference between winning and losing.

The disability lawyers at Riddle & Brantley has been helping clients in the Greensboro area and throughout North Carolina for decades. We know the system and can help you navigate the entire claims and appeal process from start to finish.

How Do I Qualify for Social Security Disability?

There are no guarantees that you will be approved for disability benefits, but there are many factors the Social Security Administration considers when determining whether you qualify.

The SSA uses what they call a “Five-Step Sequential Analysis” as their method for determining whether an applicant is eligible for benefits.

The analysis goes like this:

  1. Are you working? In order to qualify for disability benefits from the SSA, you cannot earn more than around $1,200 per month. It does not matter how sick or injured you are; if you are working and earning that much, you are, by definition, not disabled.
  2. How severe is your condition? The SSA will try to determine the extent to which your disability interferes with work-related activities when evaluating your application.
  3. Is your disability on the “Listings” of disabling conditions? The SSA maintains a list of conditions that automatically qualify an applicant for disability benefits if they meet certain other criteria. You can view this list — called the “Blue Book” — on the SSA website.
  4. Can you do the same work you are accustomed to? You may qualify for Social Security disability benefits if your condition prevents you from doing the same type of work that you have done for many years, and you also meet additional criteria.
  5. Can you do any other type of work? The SSA will determine whether your disability prevents you from doing other suitable work with your remaining abilities (sometimes called your “residual functional capacity”).
