Courts have interpreted cruel and unusual punishment to be that which “shocks the conscience,” and this amendment has been used in police brutality cases concerning physical and sexual assault, denial of medical care to those in custody, and more.

The Fourteenth Amendment — The Fourteenth Amendment, along with the Fifth Amendment, protects an individual’s right to due process. This amendment states that no one shall be denied life, liberty or property without due process of law.
