“How Can I Qualify for Disability?”
In order to qualify for Social Security disability benefits, you must meet a set of strict criteria set out by the Social Security Administration (SSA). The SSA follows a 5-step “sequential analysis” in determining eligibility for SSD benefits.
- Are you working? — In order to qualify for SSD benefits, a person cannot earn more than $1,310 per month in income. If you earn more than that, by the SSA’s definition, you are not disabled.
- How severe is your condition? — Your disabling condition must be severe enough that it “significantly interferes” with your ability to perform work-related activities.
- Do you meet a “Listing”? — The SSA maintains a list of disabilities that are automatically assumed to be so debilitating that they automatically qualify you for Social Security disability, provided you meet certain other criteria. If you don’t meet a specific “Listing,” however, you may still qualify based on other criteria (see below).
- Can you do the same work you’ve been doing? — The SSA will seek to determine first if you can perform work similar to a job you’ve performed in the last 15 years, using what’s called your “Residual Functional Capacity” or RFC.
- Can you do a different type of work? — If you can’t perform a job you’ve done in the last 15 years, the SSA will then determine if you can perform a different type of work using your RFC.
The criteria for disability can be confusing, and a Durham disability lawyer at Riddle & Brantley can help.

What to Do If You’ve Been Denied Disability Benefits

You have the right to a hearing and unfavorable decisions can be appealed. As a last resort, a lawsuit can even be filed in federal court.
A Durham disability lawyer can help you navigate the complexities of filing for disability benefits or appealing a denial.

- Seeking help from your doctors in supporting your claim by doctor letters and Residual Functional Capacity evaluation forms
- Organizing your records and highlighting important ones to the judge who hears your case
- Cross-examining witnesses at your ALJ hearing
