What to Do After an Injury at Work

First, if possible, you should immediately inform your supervisor or manager of your accident. Under North Carolina law, every injured worker must report an accident as soon as it is practical. The notice must be given within 30 days. Workers who do not file an accident report within this timeline may not be eligible for benefits. Be sure to speak to your HR Department. When in doubt, report sooner rather than later.

Contact a lawyer if you do not know how to report your accident or if your employer attempts to pressure you into concealing the accident or the illness. Reporting is not the same as filing a workers’ compensation claim, which generally has a two-year statute of limitations.

Seek Medical Care

It’s important to remember that your medical records are essential in establishing a causal link between the accident and your injuries.

Your employer may insist you seek care from a list of pre-approved doctors. They must, however, cover the costs if you need emergency services (e.g., if you’ve broken a bone). For follow-up visits, you will probably have to see a provider from their approved roster of healthcare professionals. You may have the right to ask for a second opinion from a doctor of your choice.

Finally, be sure to follow your doctor’s orders. If you deviate from their standard of care, it may lead to a termination of your benefits.

Document Evidence

If possible, gather evidence to substantiate your claim:

  • Take photographs of the accident site

  • Obtain CCTV footage or videos from phones, if possible
