“How Do I File a Claim for Workers’ Compensation?”

The process for filing a claim for workers’ compensation in North Carolina can be complicated, time-consuming, and stressful. Some of the most important steps in seeking workers’ compensation benefits for your workplace injury include:

  • Notifying your employer of your injury in writing (Form 18) — you are required to submit notice of your workplace injury with the North Carolina Industrial Commission (NCIC) via Form 18 within 30 days of the accident
  • Ensuring that your employer complies with the law — your employer must file your Form 18 and their own Form 19 with the NCIC — a work injury attorney can help ensure their compliance, and you also have the option of submitting Form 18 directly to the NCIC yourself
  • Documenting evidence — you must prove that your workplace injury was the result of an “accident” that occurred in the normal scope of your employment duties; additional evidence such as co-worker testimony and photos may also help support your workplace injury claim
  • Seeking medical treatment — in order to successfully claim workers’ compensation, you must demonstrate the extent of your injuries with documented medical treatment
  • Seeking a hearing if your initial claim is denied — an experienced workers’ comp attorney can help appeal your claim to the NCIC and even take your case to court if necessary

A Record of Success Handling Work Injury Claims

In more than three decades of service to injured North Carolinians, Riddle & Brantley’s workers’ compensation lawyers have secured many significant judgments and settlements on behalf of our deserving clients.

Recent work injury claim settlements and verdicts include:

  • $2,750,000 | Construction Accident — Our client, a construction worker, was seriously injured when he was struck by a heavy truck driving through a work zone. He suffered extensive injuries, including the eventual loss of his right leg below the knee. Attorneys Gene Riddle and Adam Smith took the case, filing separate personal injury and workers’ compensation claims, eventually recovering $2.75 million in total compensation.
  • $2,475,000 | Fall — Riddle & Brantley attorneys fought for justice on behalf of a North Carolina welder who fell from a platform and suffered a disabling head injury. We obtained a guardianship and established two trusts to provide for his long-term care, and after several mediations secured $2.475 in total compensation for his injuries.
  • $725,000 | Heavy Lifting Injury — Attorney Gene Riddle represented an injured worker who suffered serious back and spinal cord injuries while carrying heavy objects on the job. The Defendant denied our claim and attorney Riddle argued the case before the North Carolina Industrial Commission (NCIC), where he obtained a favorable verdict. The case ultimately concluded with a mediated settlement of $725,000 including a Medicare Set Aside provision for future medical expenses.
  • $1,800,000 | Truck Accident — We represented a truck driver who was hit head-on while driving on the job and suffered serious injuries, including the eventual loss of his left leg below the knee. Attorney Gene Riddle was able to work out settlements with two insurance carriers, totaling $1.8 million in compensation.
