The other important indicator that these bellwether cases will present is how much compensation juries may award to plaintiffs if they do win these Similac lawsuits. These amounts won’t guarantee future outcomes, but may provide a reasonable estimate for potential Similac settlement amounts going forward.

Johnson & Johnson Talcum Powder (2020)

Johnson & Johnson recently agreed to pay out $100 million to settle 1,000+ cases alleging that their talc-based baby powder contained cancer-causing asbestos. What’s more, they are currently trying to avoid paying this settlement through an unusual legal maneuver called the “Texas two-step.” Under this scheme, talcum powder liabilities have been transferred into a new subsidiary company, which then filed for bankruptcy. If the bankruptcy filing is approved, it may allow Johnson & Johnson to avoid significant liability.

Roundup Weed Killer (2021)

Bayer has agreed to a global settlement with plaintiffs in lawsuits that claim the company did not properly warn consumers of cancer risks potentially associated with the popular weed killer Roundup. Bayer has settled roughly 80% of 125,000 claims brought against the company after it acquired Monsanto (the original Roundup manufacturer) last year. In total, Bayer expects to pay out approximately $11 billion in settlements once all the claims are completed. Legal analysts generally expect qualifying plaintiffs in Roundup cases to receive settlements in the range of $10,000 to $250,000, depending on the unique facts and circumstances of each case.

How Much Might Potential Enfamil Settlements Be Worth?

Based on legal analysis by leading experts and the above-mentioned settlements in similar product liability cases, it seems reasonable to estimate that qualifying plaintiffs in Enfamil baby formula lawsuits might expect somewhere in the range of $10,000 to $200,000 for an NEC claim supported by strong evidence.
