Who qualifies for disability benefits?
The Social Security Administration uses five questions to determine whether or not a person qualifies for disability benefits:
Are you working?
A person cannot earn more than $1,180 per month in wages in order to qualify for SSD benefits.
How severe is your condition?
The SSA evaluates whether or not your condition significantly interferes with work-related activities in determining whether or not you qualify for benefits.
Is your disability on the SSA list of disabling conditions?
The Social Security Administration has a list of conditions that automatically qualify a person for benefits if they meet other criteria. You can view the list of disabling conditions on the SSA website.
Can you do the same work?
If your disabling condition prevents you from doing the same type of work that you have performed during the past 15 years, you may qualify for benefits if you meet other criteria.
Can you do any other type of work?
In order to qualify, your condition must prevent you from transitioning to other suitable work using your remaining abilities (“residual functional capacity”)
If you meet these criteria and are interested in applying for disability benefits or appealing a denial, talk with a Raleigh disability lawyer today.
