Bayer Seems Serious About Potential Roundup Settlement

Riddle Brantley LLP   |  July 17, 2019   |

Following a series of high-profile losses in civil court and facing more than 13,000 additional lawsuits, Bayer is sending signals that a Roundup lawsuit settlement may be happening soon. A Roundup settlement would have far-reaching consequences for the thousands of groundskeepers and agricultural workers who allege the popular weed killer caused their cancer.

In May the manufacturer of the popular herbicide Roundup was slapped with a $2 billion judgment by a jury that found Monsanto — a Bayer subsidiary — “failed to warn of the herbicide’s cancer risk and that the company acted negligently.”

Two previous jury trials also resulted in multi-million dollar judgments against Monsanto.

Roundup Settlement Could Reach $10 Billion - Riddle & BrantleyA federal judge recently appointed Kenneth Feinberg, a lawyer known for mediating settlements in major class action and mass tort lawsuits, to work toward a Roundup settlement with Bayer to resolve outstanding claims. Feinberg previously helped negotiate settlements involving September 11 first responders, victims of the BP Deepwater Horizon spill, and the Volkswagen diesel emissions scandal.

While Bayer insists that its glyphosate-based weed killer is safe and has vowed to continue fighting the Roundup lawsuits, the company recently hired a law firm to advise a committee set-up to resolve the litigation. Last week, Bayer CEO Werner Baumann additionally met with investors to discuss the lawsuits and a potential Roundup settlement.

According to legal analysts, negotiations could result in a potential Roundup lawsuit settlement as high as $10 billion.
