Bayer to Stop Selling Roundup for Residential Use in 2023

Riddle Brantley LLP   |  August 3, 2021   |

On July 29th, 2021, pharmaceutical and agricultural giant Bayer announced that they would stop selling glyphosate-based products, including popular weed killer Roundup, to residential consumers starting in 2023. This is part of a five-point plan to reduce the risk of future Roundup lawsuits surrounding allegations that exposure to Roundup and other glyphosate products leads to an increased risk of cancer in some users.

IMPORTANT: While most Roundup lawsuits have already settled (or are in settlement negotiations), there is still time to file a Roundup claim provided the case meets certain criteria. If you or a loved one has been diagnosed with non-Hodgkin’s lymphoma or chronic lymphocytic leukemia after exposure to Roundup, please call 1-800-525-7111 today for a free consultation.

Bayer Denies Roundup’s Alleged Link to Cancer

Bayer to Stop Selling Roundup for Residential Use in 2023 - Riddle & BrantleyWhile Bayer continues to claim that Roundup is safe and that “this move is being made exclusively to manage litigation risk and not because of any safety concerns,” over 150,000 claims have already been made alleging that Roundup exposure led to the development of non-Hodgkins lymphoma (NHL) and chronic lymphocytic leukemia (CLL).

Bayer denies any negligence or wrongdoing related to Roundup, as well.

While Roundup may be leaving the consumer shelves, this plan does not include any intention to discontinue its sale or use in commercial agriculture. Even with these changes, many people may still be at risk due to previous exposure to Roundup or continued exposure from its use in agriculture.

Why is Bayer Removing Roundup from Consumer Shelves?

Studies have linked exposure to glyphosate (such as is present in Roundup) to an increased risk for occurrences of Non-Hodgkins lymphoma and other cancers. Since these studies were released, thousands of lawsuits have been brought against Bayer.

These lawsuits are so extensive that Bayer recently set aside over $4.5 billion to help settle them, following a separate Roundup “global settlement” totaling more than $10 billion. Not all Roundup plaintiffs have agreed to the global settlement, however.

According to Bayer’s press release, “the vast majority of litigation claims come from Lawn & Garden market users.” So, to stave off future consumer lawsuits, the decision was made to begin phasing out the sale of Roundup and other glyphosate-based products in the consumer market.

Why Will Roundup Still Be Used in Commercial Agriculture?

Roundup Removed from Consumer Market in 2023 - Riddle & BrantleyBecause Bayer is maintaining their position that pulling Roundup from consumer shelves is a litigation defense and not a safety concern, they will continue selling Roundup herbicide for commercial agriculture applications.

This means that if the studies linking glyphosate to non-Hodgkin’s lymphoma and other cancers are correct, agricultural workers and other individuals exposed to commercial agriculture environments may still be at risk from these commercial products, which remain on the market.
