“I’ve been denied disability by the VA. What can I do?”
Most initial applications for VA disability are denied. In fact, roughly 70 percent of applicants are denied. But that doesn’t mean you don’t have options.
According to a recent report, errors are made in roughly 60 percent of veterans benefits decisions. An experienced VA disability lawyer serving Salisbury can help you prepare the best possible case for benefits.
If you want to maximize the chances that you are approved for benefits, you may want to consider hiring a VA disability lawyer.
Studies from the VA show that by hiring a veterans benefits attorney, you can increase your chances of approval by as much as 40 percent.
That’s a big difference. You don’t have to do this alone.
Our North Carolina veterans benefits lawyers know the Veterans Affairs system inside and out and can help you prepare your appeal or request for an increased rating.

“How does VA disability actually work?”
When you qualify for veterans disability benefits, you will receive a monthly payment from the government. This payment is based in part on your VA disability rating, which is a percentage representing the VA’s estimation of your disability.
For instance, if you receive a 10% disability rating, you are eligible for $142.29 per month in VA disability payment. If you receive a 100% disability rating, you are eligible for $3,106.04 per month.
You can receive additional money depending on your marital status and whether or not you have dependent children. More information on current VA disability compensation rates is available on the VA website.
“Do I qualify?”
You may qualify for VA disability if you meet certain criteria established by the VA and can provide documented evidence supporting your claim.
In order to be eligible for veterans disability payments, you must:
- Have served in active duty, active duty for training, or inactive duty for training
- Have been at least partially disabled due to injury or illness that is “service-related”
- Have received a discharge other than dishonorable
You must also provide evidence of the following:
- Your disabling condition, based on a “Compensation & Pension” examination or “C&P” exam
- That your disabling condition is the result of an injury or illness suffered in the course of your military service (that your injury is service-related)
In order to provide this evidence, you may submit medical records, service records from your time in the military, and even outside testimony of service members, family members and friends.
A veterans disability attorney serving Salisbury and greater NC can help you determine your eligibility and put together the best possible case for disability benefits from the VA.
