Raleigh responds to allegations after man killed when home struck by vehicle

WRAL.com reports that a man was killed Sunday around 12:30 a.m. when his home was struck by a vehicle, apparently operated by a drunk driver.  The collision is the fourth time the home has been struck by a vehicle in recent years, but the City of Raleigh has refused to install guardrails around the curve.

Claims against Cities and the State for failure to properly engineer roads can be extremely difficult.  Claims against the State or its entities such as the D.O.T. must be brought in the North Carolina Industrial Commission.  Often, such claims also involve private contractors or engineers who took part in construction of the roadways.  Cities and counties will often claim sovereign immunity for their parts in defective construction claims, but typically, courts will rule that they are liable to face suit in state courts for negligent road maintenance.
