There is No Best Workers Compensation Lawyer, But There Are Specialists

If you’ve been injured at work, you may be filing a workers’ compensation claim, and there’s a pretty good chance you’ve been searching for best workers compensation lawyer on Google or elsewhere.

The fact is, there is no such thing as the best workers’ compensation lawyer.

Every case is different, and ultimately choosing the right workers’ comp lawyer for you is a personal decision. There are many factors to think about in deciding which lawyer is right for your case.

That being said, you may want to consider a Board Certified Specialist in workers’ compensation law. A Board Certified Specialist in workers’ compensation is an attorney that is certified by the North Carolina State Bar to be proficient in the field of workers’ compensation law. Board Certification in workers’ compensation law recognizes special distinction and proficiency.

This doesn’t mean that a Board Certified workers’ compensation specialist is the “best workers compensation lawyer” (there’s no such thing), but it does mean that such a specialist might be right for your workers’ comp case.

What Makes a Board Certified Workers’ Compensation Specialist Different?

As of this post’s publishing, there are only 145 Board Certified workers’ compensation specialists in North Carolina.

The process by which a workers’ compensation lawyer becomes a Board Certified Specialist is rigorous.

In order to become a Board Certified Specialist, the lawyer must satisfy a number of demanding requirements, including a 6-hour exam. Before he or she can even take the exam, the lawyer must first prove that he or she has:

  • practiced workers’ compensation law for a certain number of years
  • devoted a certain amount of time to workers’ compensation law each year
  • attended a number of legal education courses or seminars in workers’ compensation law
  • been peer-reviewed by other workers’ compensation attorneys

Many workers’ compensation specialist attorneys work for insurance companies, private employers, or the government. However, some of these workers’ compensation specialists dedicate their careers to representing injured workers.

The reality is there is no such thing as the best workers’ compensation lawyer, and the North Carolina State Bar has actually ruled it is unethical for an attorney to promote him or herself as such.

All workers’ comp cases are different and deciding which attorney is right for you is a personal decision.
