Motorcycle Accidents in North Carolina

Every day, motorcycle accidents occur throughout North Carolina, many of which end with severe personal injury or in some cases a fatality. In 2019, approximately 3,516 motorcycle accidents occurred in North Carolina according to the NCDOT 2019 Crash Facts report.  When riding a motorcycle, it's important to remember that you are entitled to the full use of a lane. It's other drivers' responsibility to make sure they are vigilant and careful around motorcycle drivers. Whether you're a motorcyclist or your loved one rides a motorcycle, it's important to know what steps to take if an injury occurs as a result of a motorcycle accident.

Were you injured in a motorcycle crash? Did you lose a loved one in a fatal motorcycle accident? Did a negligent driver argue that he or she did not see you, or blame you for a collision? If so, an experienced North Carolina motorcycle accident lawyer may be able to help you get the compensation you deserve. At Riddle & Brantley, our North Carolina motorcycle accident attorneys fight tirelessly to hold negligent drivers accountable and secure justice for injured motorcyclists and their passengers.

In more than three decades serving the people of North Carolina, our motorcycle accident lawyers have handled hundreds of motorcycle accident claims, recovering millions of dollars in compensation for injured riders (see disclaimer below).

Recent case results include:

  • $1,000,000 — Our client was a passenger on a motorcycle when the driver lost control in an S-curve. She was thrown from the bike and suffered extensive and life-changing injuries, including traumatic brain injury and multiple fractures. Our investigation determined that the driver was at fault in the accident and we filed a civil claim, ultimately securing $1 million in total compensation on behalf of our injured client.
  • $1,000,000 — We represented a motorcyclist who was hit when a truck failed to stop at a stop sign. Our client was thrown 15 feet from the motorcycle and suffered life-threatening injuries. The other driver was charged in the accident and our attorneys filed a civil claim, eventually securing $1,000,000 in total compensation as part of a negotiated settlement. The settlement represented the limits of the policy in question.
  • $300,000 — Our client was t-boned while pulling his motorcycle onto a busy highway. The other driver was found to be negligent in the accident after investigation and we aggressively pursued justice on our client's behalf, ultimately negotiating a total settlement of $300,000, representing the limits of the insurance policy.

Serious Attorneys for Serious Motorcycle Accident Injuries

Motorcycles provide relatively little protection for their riders, as compared to cars and trucks. As a result, motorcycle accident injuries are often much more serious than those caused by other collisions. North Carolina law does include several regulations to promote motorcycle safety. However, many times negligent drivers cause motorcycle accidents by driving recklessly or failing to yield the right of way to motorcyclists. Often, distracted or negligent motorists may overlook motorcycles altogether, causing serious and potentially fatal crashes.

In more than 35 years handling these cases, our attorneys have represented motorcycle accident victims who have suffered all kinds of injuries, including:

  • Broken bones
  • Cuts, scrapes, and contusions
  • Head injuries
  • Traumatic brain injury (TBI)
  • Concussions
  • Brain bleeds (hemorrhages)
  • Spinal cord injuries
  • Back injuries
  • Neck injuries
  • Shoulder injuries
  • Hand injuries
  • Loss of limbs (amputations)
  • Burns
  • Emotional trauma such as PTSD
  • Death

In cases in which injuries result in long-term disability, our Social Security disability lawyers are ready to assist with these claims and appeals, as well. In the most heartbreaking cases, our wrongful death lawyers can fight for justice for surviving family members.

Investigators On Staff

Motorcycle Accident Investigators on Staff - Riddle & Brantley

The immediate aftermath of a motorcycle accident can be critical in determining the outcome of your case. Our experienced personal injury lawyers are supported by a team of investigators led by retired law enforcement officers. These investigators can immediately begin collecting and documenting evidence, interviewing witnesses, and helping prove liability. In many cases, we'll even bring in outside experts like accident reconstructionists to help strengthen your case.

What to Do Immediately After a Motorcycle Accident

If you've been injured in a motorcycle accident in North Carolina, follow these tips to protect yourself and help preserve your legal rights:

  • Seek Medical Attention — Even if you don't believe you are severely injured, it's important to seek immediate medical attention. Some injuries suffered in a motorcycle accident may not be immediately apparent, and advanced imaging may be necessary to help dangerous brain injuries. Follow the recommendation of the first responders at the scene and proceed to the hospital immediately if you've been hurt. In addition to protecting your health and safety, getting medical treatment will be important in pursuing a motorcycle accident injury claim or lawsuit.
  • Call 911 — In addition to getting the medical help you need, calling 911 will ensure that law enforcement responds and that an accident report is filed. A police report will be critical in helping prove your motorcycle accident injury case. Talk with the responding law enforcement officer and be honest and straightforward. Do not admit fault and do not apologize, but remember that anything you say can and will be used against you.
  • Take Photos — If you are able, document the motorcycle accident evidence at the crash scene, including vehicle damage, debris, skid marks, road signage, road markings, and anything else significant. Be sure to also get photos of any injuries. If you've been severely injured, another person can help take photos.
  • Get Witnesses' Contact Info — Talk with potential witnesses and get their contact information. Witness testimony may prove invaluable in pursuing a motorcycle accident injury claim or lawsuit.
  • Don't Give a Recorded Statement to the Insurance Company — Insurance adjusters will often immediately seek an official and/or recorded statement. Do NOT give a recorded statement to an insurance company without first talking with an experienced North Carolina motorcycle accident lawyer.
  • Call a Motorcycle Accident Lawyer — An experienced personal injury lawyer handling motorcycle accident injury claims can advise you on your legal rights, investigate the circumstances of the crash, and help determine the best path forward for seeking compensation. At Riddle & Brantley, we can consult with you via phone, email, text, and even video conference. The consultation is always free and you won't pay any attorney fees unless we recover compensation for you. Call 1-800-525-7111 for a free consultation immediately after the accident.

Motorcycle Laws in North Carolina

In North Carolina, motorcyclists must follow the same basic rules of the road as operators of other vehicles. However, there are several laws which pertain specifically to motorcyclists. These include, but are not limited to:

Lane Use

Most operators of vehicles may not know that the law entitles a motorcycle to the full use of a lane, just like any car or truck. Therefore, no motor vehicle shall be driven in such a manner as to deprive any motorcycle of the full use of that lane. In addition, two motorcycles may lawfully operate abreast in one single lane at the same time. However, motorcyclists shall not ride more than two abreast in one single lane. (N.C. Gen. Stat. § 20-146.1).

Lights

North Carolina also requires that motorcyclists keep both the headlamps and rear lamps their bikes illuminated at all times while the motorcycle is in operation on the highways or other public vehicular areas. (N.C. Gen. Stat. § 20-129).

Helmet Laws

Most importantly, North Carolina requires all motorcyclists and moped drivers to wear safety helmets. These helmets must comply with Federal Motor Vehicle Safety Standards. Likewise, this law limits the number of passengers on the motorcycle or moped to the number of persons it was designed to carry. (N.C. Gen. Stat. § 20-140.4).

Motorcycle Safety Tips for Riding in North Carolina

Changing road conditions can significantly increase the chances of a motorcycle accident. Here are some safety tips to keep in mind if you're riding a motorcycle in any of the following conditions:

  • Uneven surfaces — Broken pavement, bumps, potholes and debris in the road can create dangerous driving conditions. Try to avoid these obstacles by slowing down and going around them. If you cannot go around an obstacle like this, then approach it as close to a 90-degree angle as possible. Slow down and keep the motorcycle in an upright position. Also rise slightly off the seat with your weight on the foot pegs; absorb the shock with your elbows and knees. Just before you hit the uneven ground, slightly roll on the throttle. This will lighten the front end. After a hard impact, pull off to the side of the road (when safe); check the bike for any damage.
  • Wet surfaces — Wet pavement, gravel, mud, snow, and ice are all tough surfaces to ride on since there is little traction. Steel plates, manhole covers, and lane markings are also slippery when wet. To ride safely on wet surfaces, reduce your speed, avoid sudden moves and use both brakes. Make sure to squeeze the front brake slowly so the front wheel does not lock. Also, use gentle pressure on the back brake. When it rains, ride in the tire marks left by other vehicles; the middle of the lane may be very wet.
  • Ice and snow — Try to avoid roads covered in ice and snow. If you must go out on an icy surface, then drive slowly. If possible, coast very slowly and stay off the brakes. Attempting this maneuver at any speed other than the slowest of speeds could be very dangerous. Additionally, stay alert for black ice and slippery patches that may be difficult to see.
  • Railroad tracks — Should you be riding over railroad tracks or pavement seams, it is safer to ride straight into your lane. Turning to take tracks head-on at is dangerous. This path could carry you into another lane of traffic. Cross any track or road seam that runs parallel to you at a 45-degree angle. After crossing, make a sharp, quick turn back into your lane. Edging across the tracks could catch your tires and throw your motorcycle off balance.
  • Grooves or bridge gratings — Maintain a steady speed and ride straight across these kinds of surfaces. You may feel uneasy and your motorcycle may wander slightly, but know that this is usually not hazardous. If you cross at an angle it may cause your bike to zigzag, creating a dangerous situation

Riddle & Brantley wants all drivers on the road to drive safely, including motorcycle riders. However, if you are involved in a motorcycle accident in North Carolina, then our attorneys are here to help.
