Have you been denied by the Social Security Administration?

The reality is that usually people who apply for disability benefits are turned down at least twice.

In most cases, this is just part of the process.  It is important that your doctors acknowledge that your condition/conditions are severe enough to meet the regulations that govern eligibility for social security disability.

This can be a highly complex, time-consuming and stressful process.

It is helpful to have a disability lawyer on your side to aid you in making this happen.

Riddle & Riddle disability lawyers have been helping clients in the Charlotte area and throughout North Carolina for decades. We know the system and can help you navigate the claims and appeal process.

For a FREE consultation with a disability lawyer, please call (704) 486-5824.

You can also complete the fast and easy online form.

Call (704) 486-5824 and let’s evaluate your case. You may be entitled to disability benefits and we would love to help you if we ca.

How Do I Qualify for Social Security Disability?

There are many factors the Social Security Administration considers when determining whether you qualify for disability benefits.

The SSA uses 5 key questions to help determine your eligibility:

  1. Are you working? In order to qualify for disability benefits from the SSA, you cannot earn more than $1,180 per month.
  2. How severe is your condition? The SSA will try to determine to what extent your disability interferes with work-related activities when evaluating your application.
  3. Is your disability on the list of disabling conditions? The SSA maintains a list of conditions that automatically qualify an applicant for disability benefits if they meet certain other criteria. You can view this list — called the “Blue Book” — on the SSA website.
  4. Can you do the same work you are accustomed to? You may qualify for Social Security disability benefits if your condition prevents you from doing the same type of work that you have done for many years, and you also meet additional criteria.
  5. Can you do any other type of work? The SSA will want to know whether your disability prevents you from doing other suitable work with your remaining abilities (sometimes called “residual functional capacity”).

The Social Security Administration has listed the types of impairments which would legally deem individuals disabled.

Of course, once one or more of these conditions has been identified, an individual must complete the application process, meet certain other criteria, and be approved in order to begin receiving these types of benefits.

Impairments Qualifying Adult Applicants for Disability

These impairments are listed in the SSA “Blue Book” and are applicable to people age 18 and over and to children under the age of 18, where criteria are appropriate.

Remember, just because you have one of the following conditions does NOT necessarily mean you will be approved. A disability lawyer with experience helping clients can help improve your chances of receiving benefits.

The list of adult impairments includes:

  • Cancers of many types
  • Respiratory diseases
  • Cardiovascular diseases and conditions such as stroke and heart disease
  • Diseases affecting the digestive system, such as colitis and Crohn’s disease
  • Genitourinary impairments
  • Blood disorders
  • Skin disorders
  • Endocrine disorders
  • Congenital disorders that affect multiple body systems
  • Neurological conditions such as ALS, MS or Parkinson’s disease
  • Mental disorders such as anxiety disorders, bipolar disorder and schizophrenia
  • Malignant neoplastic diseases
  • Disorders of the immune system
  • Special senses and speech difficulties
  • Musculoskeletal system disorders

If your condition has been identified, it is advised that you speak with an attorney and begin exploring your legal options, as you may be eligible to receive Social Security Disability benefits.
