Johnson & Johnson, makers of the DePuy ASR hip implant, have agreed to set aside as much as $420 million to settle previously ineligible lawsuits over the company’s recalled hip implants.
The hip implants are known to cause metal poisoning in patients who received them, and required extensive surgeries to remove and replace the defective implant. The metal-on-metal implants were supposed to last for 20 years, but were recalled in 2010 after the implants caused dislocations, pain, and blood poisoning.
The ASR hips were recalled after medical documentation showed that at least 12% of implants failed within five years. Internal documentation from Johnson & Johnson and DePuy suggested that the failure rate could be as high as 44%.
In 2013, Johnson & Johnson and DePuy decided to settle the defective hip claims en masse, and created a settlement program to compensate those injured by the hip implants. The fund required an injured person to have had hip replacement surgery before Aug. 31, 2013.
However, approximately 1,400 people needed surgery as a result of these defective hip implants between Aug. 2013 and today. In response to the increasing outcry of those who were not eligible for settlements, Johnson & Johnson decided to extend the settlement program. Now, patients who required removal or replacement surgeries before Jan. 31, 2015, are eligible to claim compensation from the fund.
The agreement to pay newer claims means that Johnson & Johnson will be spending approximately $4 billion to resolve its defective hip claims. Individual claimants can expect to receive approximately $300,000 for each defective hip implant, with some exceptions.
