The case involved the tragic death of a family of four killed when a pavement marking company caused traffic to back up on a North Carolina highway. Two tractor-trailer trucks were unable to stop in time. A tanker truck slammed into the back of the family’s pickup killing them instantly. Our attorneys filed suit and settled the claims against two trucking companies for $5.45 million (the limits of their insurance).

The key to successfully resolving these cases and proving liability on the pavement marking company was the extensive investigation and hiring of experts to prove our case. We even subpoenaed data from Google Maps which showed how fast traffic was traveling during the hours before the wreck. This data was vital to prove negligence on the part of the pavement marking company.

One week before trial, Google provided a witness to prove that their data was accurate regarding the backup of traffic which triggered the accident.  The case settled the next day for $4 million, bringing the total settlement to $9,450,000.

Sheriff’s Employee Had Sex With Inmate – Federal Claims – Cruel And Unusual Punishment – Court Imposed $5 Million Judgment A former Wayne County sheriff’s deputy was indicated on 22 counts of sexual activity by a custodian. In May of 2001, he entered an Alford plea to five counts and was sentenced to 90 days in prison, according to the plaintiffs counsel, Gene Riddle. From 1997 until 1999, several different women said that while they were in jail, the former deputy, Bobby Braswell, waited until all other employees left and then signed the women out, taking them downstairs to the detective’s office and demanding sex, Riddle states. He represented five of these women. Their suits against Wayne County and the sheriff’s department were settled. Last year, the plaintiff in Fordham sued Braswell in federal court, alleging that he violated her constitutional protection against cruel and unusual punishment. Our valued client was driving a truck for his employer when a dump truck crossed the center line and hit him head-on. Our team represented a laborer in a denied worker’s compensation claim. He claimed that he had sustained an injury to his leg while on the job. Our client, a 50-year-old employee of a cellular tower company was struck by a falling tree while in the woods scouting locations for cell towers. He suffered severe head injuries with cognitive deficits, semi-paralysis on the left side of the body, and fractures to his left leg. Two seventh grade boys were hit by a car right in front of their school when they attempted to cross the road in the crosswalk under the direction of a green walk arrow. Our client was riding his motorcycle when an SUV turned left from a side street into client’s path. Our client made evasive maneuvers but the SUV still crashed into our client, causing severe injuries.

In 2014, as part of a highway-building project in a rural county in Eastern North Carolina, the North Carolina Department of Transportation took roughly 4 acres of a twenty-acre parcel along the frontage of a county road. The DOT took a family home and a mobile home on the property and controlled access to the property so that the remainder of the property (the remaining 16 acres) was significantly damaged and reduced in value. The landowner felt DOT’s appraiser significantly undervalued the home on the property because of the lack of viable sales in the area and undervalued the property due to the lack of zoning for the rural property. Further, the damages to the remainder of the property were not adequately assessed.

The DOT had stalled at the offer of approximately $384,000. At mediation, a Riddle & Riddle attorney was able to use owner opinion testimony and information from a local broker to increase the DOT’s offer to $497,000 and secure two additional parcels of land. These additional parcels gave the landowner access from the roadway again, thereby increasing the value of the remaining 16 acres by several thousand dollars.

On a highway-widening project in eastern North Carolina, the North Carolina Department of Transportation (DOT) took roughly 4.1 acres of a 50-acre parcel. The property initially had several hundred feet of road frontage, a family home, a rental home, 2 garages, a couple of wells, a buck barn, and a roughly 40-acre farm and 5 access points to a major highway. After the DOT’s taking only one access point on the southern end of the farm remained, and all of the buildings were gone except for the buck barn. The northern field was no longer accessible because the condemnor had put in water drainage that, when combined with an existing ditch, separated the larger northern field from the southern field.

Through front-end negotiation, a Riddle & Riddle attorney was able to convince the DOT to give the property owner another access on the northern end of the field in order to reclaim some of the property’s value. Our team helped the client facilitate the sale of the remaining property for its remaining value to a third party while retaining the rights to the proceeds of the condemnation, which settled at mediation with the DOT in the amount of $490,000.

The Defendants appealed the ruling of the Deputy Commissioner, and after submission of briefs and oral arguments in front of the 3-judge panel of the Full Commission, the Deputy Commissioner’s Opinion and Award was upheld by unanimous decision. The Full Commission set aside the punitive attorney’s fee award.

The Defendants appealed the Full Commission ruling to the North Carolina Court of Appeals, asking for the prior rulings to be reversed and set aside.

The case settled for the sum of $170,000 and all costs as well as waiver of the health insurance lien, prior to the parties settling the Record on Appeal.

According to the official police investigation, our client’s unoccupied vehicle was parked on the street in front of his house where it was clipped by a drunk driver, causing minor damage.
