Who can obtain veterans benefits?
Veteran disability benefits are for veterans with service-connected mental and physical impairments. The Veterans Administration (VA) has guidelines outlining eligibility for VA disability. There are several hurdles that often prevent veterans from receiving these benefits in North Carolina:

Are veterans benefits available for National Guard and Reserve personnel?
Typically, National Guard and Reservists are not eligible for veterans benefits.
However, if you were activated by the federal government, you may be eligible to receive VA benefits.
Unfortunately, activation by state governments does not qualify you for Veterans Benefits from the Veterans Administration.
How much will I receive from the VA?
The amount you will receive from the Veterans Administration depends on your physical and/or mental impairments as measured by your VA disability rating.
A VA disability rating is based on the number and severity of mental and physical conditions combined. The rating you receive (recorded as a percentage in denominations of ten percentage points like “20%,” “40%,” “1005” etc.) will determine how much you will be paid monthly.
If you receive a low VA disability rating, you are not required to accept and do have the option to appeal for a higher rating. A veterans benefits lawyer can help position your case to improve your likelihood of receiving a higher rating.
Will I be eligible for backpay?

To obtain a favorable decision and receive veteran’s disability benefits, you must make a strong case to the VA.
You must meet the following criteria to be eligible for VA disability:
- You must have served in active duty, active duty for training or inactive duty for training.
- You must have received a discharge other than dishonorable.
- You must have been at least partially disabled by an injury or disease suffered while in military service.
