Who can obtain veterans benefits?

Veteran disability benefits are for veterans with service-connected mental and physical impairments. The Veterans Administration (VA) has guidelines outlining eligibility for VA disability. There are several hurdles that often prevent veterans from receiving these benefits in North Carolina:

  1. You must have a discharge other than dishonorable in order to receive veterans disability
  2. Veterans must prove their impairments are related to time in service. Many veterans in North Carolina do not obtain benefits simply because they cannot present enough evidence to prove their physical and mental disabilities are a result of injuries or illness suffered while in military service.

A veterans benefits attorney can help you determine eligibility and prepare the best possible case for VA disability benefits.

For a FREE case review with a disability lawyer, please call (252) 397-8620 or complete the short form below.

What if I was previously denied North Carolina Veterans Benefits?

Many disabled veterans in North Carolina are initially denied veterans benefits.

It is important not to become discouraged if you are denied.

If you received your denial within the last year, you may have the option to submit a Request for Review. These “appeals” can be complicated, time-consuming stressful. We strongly suggest you speak with a veterans benefits lawyer if you’ve been denied VA disability.

You don’t have to do this alone.

We’re proud to serve those who have served our country and our disability attorneys are ready to help however we can.

Are veterans benefits available for National Guard and Reserve personnel?

Riddle & Riddle - Greenville VA Disability Lawyer in North Carolina

Typically, National Guard and Reservists are not eligible for veterans benefits.

However, if you were activated by the federal government, you may be eligible to receive VA benefits.

Unfortunately, activation by state governments does not qualify you for Veterans Benefits from the Veterans Administration.

How much will I receive from the VA?

The amount you will receive from the Veterans Administration depends on your physical and/or mental impairments as measured by your VA disability rating.

A VA disability rating is based on the number and severity of mental and physical conditions combined. The rating you receive (recorded as a percentage in denominations of ten percentage points like “20%,” “40%,” “1005” etc.) will determine how much you will be paid monthly.

If you receive a low VA disability rating, you are not required to accept and do have the option to appeal for a higher rating. A veterans benefits lawyer can help position your case to improve your likelihood of receiving a higher rating.

Will I be eligible for backpay?

Many North Carolina veterans are entitled to backpay when they are approved for veterans disability payments.

The effective date for backpay will be determined from when you should have started receiving payments. Many veterans are surprised to find out their effective date was years ago, and they are owed thousands of dollars from the VA.

What if I was previously denied North Carolina VA Benefits?

Many disabled North Carolina veterans are denied VA Benefits. It’s important not to become discouraged if you have been denied. If you were denied within the last year, you may have the option to appeal.  VA Benefits appeals can become complicated.  It is important to talk to a VA disability lawyer. VA law is more complex than many veterans and their families realize.

The veterans benefits lawyers at Riddle & Riddle are here to help.

Why should I call Riddle & Riddle for my VA disability claim?

The VA benefit attorneys help veterans get the monthly compensation they deserve.  Here are a few ways we can help.

  1. Requesting a review of your denial — Roughly 30 percent of all VA disability applications are denied. You don’t have to take “no” for an answer. Our VA disability lawyers may be able to help. There may still be an opportunity to Request a Review or file a new claim.
  2. Increasing your VA disability rating — You don’t have to simply accept the first VA disability rating you are assigned. The difference between a 90% and 100% rating can be more than $1000 per month. An attorney can help increase the odds that you are awarded a higher rating.
  3. Helping you obtain Individual Unemployability — Many times, the Veterans Administration denies Individual Unemployability benefits to veterans that are not able to work from service-connected conditions. You may have options and a veterans benefits lawyer may be able to help.
  4. Helping you obtain VA disability backpay — You may be entitled to veterans disability backpay and be unaware of it. Don’t lose out on potentially thousands of dollars that you deserve. We may be able to help identify potential missing backpay and get you the full benefits you’re entitled to.

“Many of our attorneys and staff have close family ties to our military and we are proud to fight on behalf of North Carolina veterans.”

“How does applying for VA disability work?”

To obtain a favorable decision and receive veteran’s disability benefits, you must make a strong case to the VA.

You must meet the following criteria to be eligible for VA disability:

  • You must have served in active duty, active duty for training or inactive duty for training.
  • You must have received a discharge other than dishonorable.
  • You must have been at least partially disabled by an injury or disease suffered while in military service.
  • Certain other criteria may apply. Talk with an experienced veteran’s benefits lawyer at Riddle & Riddle to learn more about your options for pursuing benefits. Please call (252) 397-8620 today.

In order to qualify for VA disability benefits, you must demonstrate the following:

  • You must show medical evidence of your disability. This includes a thorough medical examination.
  • You must show evidence that your disability was caused by injury or illness that incurred in the course of your military service.

“Does my disability have to stem from active combat?”

Veterans Benefits Lawyers in Greenville NC - Riddle & Riddle

Your injury that led to disability does not have to have occurred on the battlefield or in active combat in order to qualify you for VA disability payments.

For example, if you were injured in a softball game occurring on a military base, you may still be eligible for benefits.

A veterans disability lawyer can help determine your eligibility and the best possible legal options for pursuing VA disability payments.
