“What is police brutality?”

The term “police brutality” can refer to all kinds of misconduct by police officers or other law enforcement authorities.

Common types of police brutality include:

  • Unnecessary or excessive use of force
  • Physical assault of a person in custody
  • Sexual assault of a person in custody
  • Denial of medical care to a person in custody
  • Extreme interrogation tactics
  • And more…

In the United States, the Constitution protects individuals from police brutality. These protections generally fall within four amendments:

The Fourth Amendment — The Fourth Amendment protects individuals from unreasonable searches and seizures. In general, searches and seizures by law enforcement personnel require a warrant from the court. In routine traffic stops and patrols, searches are only permitted when there is probable cause that a crime has been committed.

The Fifth Amendment — The Fifth Amendment to the Constitution contains a “due process” clause that protects individuals from self-incrimination. The “Miranda” statement read by police officers during an arrest, in which an individual is advised that “you have the right to remain silent,” stems from this amendment.

The Eighth Amendment — This amendment protects individuals from “cruel and unusual punishment.” In the United States, punishment must not be disproportionate to the crime. The prohibition of “cruel and unusual punishment” may apply to instances in which those in custody are denied medical care, or are physically or sexually assaulted.

The Fourteenth Amendment — The Fourteenth Amendment guarantees that one cannot be denied life, liberty or property without due process of the law. This can apply to police searches and seizures, or instances in which potentially excessive force results in serious injury or death, as well as many other scenarios.
