“I’ve been denied VA disability benefits. What are my options?”

If you’ve been denied disability by the Department of Veterans Affairs (VA), do not be discouraged. Roughly 30 percent of VA disability claims are denied and in many cases you can appeal and receive a favorable decision.

There are no guarantees in any case, but a veterans benefits lawyer can help advise you on your case and improve the chances that you are approved for VA disability.

If you have been denied veterans disability, you can:

  • Request a review by a Decision Review Officer (DRO) — A DRO with the local VA office can review your disability claim following a denial and see if any mistakes were made in the initial process. If your VA disability claim remains denied, you still have an option to appeal before the Board of Veterans Appeals.
  • Appeal to the Board of Veterans Appeals (BVA) — If you decide to appeal to the BVA, you must file a Substantive Appeal Form (VA Form 9). A veterans benefits lawyer can help you file and prepare for your hearing. You have 90 days to provide medical evidence and other supporting documentation to the BVA for your appeals case. You can request a hearing before a traveling judge, via video conference with a member of the BVA, or appear in-person in Washington, D.C.

The VA disability appeals process can be complicated, time-consuming and stressful. In fact, it can sometimes take months or even years for your appeal to be heard by the BVA.

You don’t have to go through this alone.

“Am I eligible for VA disability?”

In order to qualify for veterans disability payments, you must meet the following criteria:

  • Have served in active duty, active duty for training, or inactive duty for training
  • Have suffered service-related injury or illness resulting in at least 10 percent disability
  • Have received a service discharge other than dishonorable

Provided you meet the above criteria, you must also provide the following to the VA for consideration of disability benefits:

  • Medical evidence (medical examination) of your disabling condition
  • Evidence proving that your disability is the result of injuries or illness incurred while on active duty, inactive duty for training, or active duty for training

Keep in mind that your injury or illness does not have to have occurred in active combat in order to qualify you for VA disability. For example, if you are injured while on a military base, you may qualify for benefits.
