Status of Hernia Mesh Litigation and MDLs

North Carolina Hernia Mesh Lawsuit Lawyers

Thousands of hernia mesh lawsuits are currently pending in multiple federal multidistrict litigations (MDLs) across the country.

These coordinated proceedings allow similar cases to be handled efficiently in pretrial phases. Key MDLs include:

  • MDL 2846 (Ethicon Physiomesh) in the Northern District of Georgia
  • MDL 2753 (Atrium C-QUR Mesh) in the District of New Hampshire
  • MDL 2846 (C.R. Bard Davol Polypropylene Hernia Mesh) in the Southern District of Ohio

While some settlements and bellwether trials have taken place, many claims are still pending as courts continue to work through discovery, pretrial motions, and additional trials to help guide potential global settlements. Plaintiffs allege that the mesh devices were defectively designed, inadequately tested, and sold without proper warnings about risks.

IMPORTANT: Defendants in these cases strongly deny any liability and/or wrongdoing.

October 2025 Update

As of October 2025, the hernia mesh lawsuits continue to advance across several active multidistrict litigations (MDLs) involving major manufacturers such as C.R. Bard/Davol, Ethicon (Johnson & Johnson), and Atrium Medical. These cases allege that defective mesh implants caused chronic pain, infections, adhesions, and the need for revision surgeries.

Key developments this year include:

  • Bard Hernia Mesh MDL (No. 2846) in the Southern District of Ohio remains the largest, with over 21,000 pending cases as of fall 2025. The next bellwether trial—focused on Bard’s Ventralight ST and PerFix Plug devices—is scheduled for early 2026 after prior mixed verdicts.
  • Bard has faced several significant jury outcomes, including one 2024 verdict awarding more than $500,000 to a plaintiff, while other cases ended in defense verdicts. These inconsistent results have complicated potential settlement talks.
  • Ethicon Physiomesh MDL (No. 2782), now largely resolved, led to confidential settlements covering the majority of cases, signaling a path forward for other manufacturers.
  • Atrium C-Qur Mesh MDL (No. 2753) is also nearing completion following earlier settlements. Only a small number of cases remain active in federal or state courts.
  • Discovery continues into design defect and failure-to-warn claims, with plaintiffs citing internal company documents that allegedly show knowledge of product degradation and high complication rates.
  • No global settlement has yet been announced in the Bard litigation, but court-ordered mediation efforts are ongoing.

As of October 2025, the hernia mesh litigation remains active and complex. The outcomes of upcoming bellwether trials—and any subsequent settlements—will likely determine how quickly thousands of remaining claims move toward resolution in 2026.
