“How Do I File a Claim for Workers’ Compensation?”
The process for filing a claim for workers’ compensation in North Carolina can be complicated, time-consuming, and stressful. Some of the most important steps in seeking workers’ compensation benefits for your workplace injury include:
- Notifying your employer of your injury in writing (Form 18) — you are required to submit notice of your workplace injury with the North Carolina Industrial Commission (NCIC) via Form 18 within 30 days of the accident
- Ensuring that your employer complies with the law — your employer must file your Form 18 and their own Form 19 with the NCIC — a work injury attorney can help ensure their compliance, and you also have the option of submitting Form 18 directly to the NCIC yourself
- Documenting evidence — you must prove that your workplace injury was the result of an “accident” that occurred in the normal scope of your employment duties; additional evidence such as co-worker testimony and photos may also help support your workplace injury claim
- Seeking medical treatment — in order to successfully claim workers’ compensation, you must demonstrate the extent of your injuries with documented medical treatment
- Seeking a hearing if your initial claim is denied — an experienced workers’ comp attorney can help appeal your claim to the NCIC and even take your case to court if necessary
Since 1985, our personal injury lawyers have represented injured North Carolina workers seeking workers’ compensation benefits. We often accept even the toughest cases, and we’re committed to justice for ALL North Carolinians. If you have questions, we are ready to answer them and fully prepared to take action on your behalf. We understand North Carolina’s workers’ compensation laws and will help you realize the value of effective legal representation. You always have the right to consult an attorney even if your employer’s insurance carrier says your injury did not occur at work or denies you have a claim.
