A warehouse worker suffered a severe foot contusion due to a forklift accident. X-rays and MRIs did not reveal a fracture. Treatment was non-surgical, consisting of therapy, medications, and pain management referral. A functional capacity evaluation revealed medium work restrictions. At the time the plaintiff consulted with Riddle & Brantley, a pending motion to terminate his workers' compensation benefits for failing to attempt to return to work had been filed at the North Carolina Industrial Commission by insurance defense counsel.

Riddle & Brantley promptly intervened, filing responsive pleadings, objecting to the defendant’s motion. Riddle and Brantley successfully won the hearing. Following the hearing, the case was settled through negotiations between plaintiff’s counsel and defense counsel for $125,000 plus all industrial commission costs and medical expenses.
