“How Long Do I Have to File a Workers’ Compensation Claim?”

In North Carolina, the statute of limitations for workers’ comp claims is two years from the date of injury. 

Under Industrial Commission rules, you should file a Form 18 Notice with both your employer and the North Carolina Industrial Commission to ensure that your claim is properly filed before the statute of limitations expires. These forms can be tricky and have many pitfalls. For example, many employers have various corporate names, and it can be confusing which corporation or LLC you should list on your Form 18. Additionally, Form 18 asks you to define your injury, and it can be very easy to be too vague, or too specific.
