PFAS Lawsuit Guide

What is PFAS?

PFAS stands for per- and polyfluoroalkyl substances. PFAS is a group of man-made chemicals, including PFOA, PFOS, and GenX, among others. According to the Environmental Protection Agency (EPA), PFAS chemicals have been manufactured and used throughout the United States since the 1940s.

PFAS chemicals include:

  • Perfluorooctanoic acid (PFOA)
  • Perfluoroctanesulfonic acid (PFOS)
  • GenX
  • Numerous other chemicals

PFAS Exposure

Source of PFAS Exposure and Cancer Risk - Riddle & Brantley PFAS Lawsuit Lawyers

Hundreds of millions of US residents may have been exposed to PFAS through a variety of sources. PFAS chemicals are very common.

Groundwater contamination poses perhaps the greatest threat to human health. According to the Environmental Working Group, 2,337 locations in 49 states have been identified as contaminated with PFAS as of January 2021.

Beyond drinking water, however, PFAS is also found in several different types of consumer and commercial products and workplaces.

PFAS chemicals are often found in:

  • Drinking water, including contaminated municipal water supplies and well-water (often contaminated due to runoff and spills from nearby factories)
  • Food packaged in PFAS-containing materials, processed by PFAS-containing equipment, or grown in PFAS-contaminated soil or water
  • Commercial household and cleaning products
  • Consumer products like non-stick cookware, stain-resistant furniture and upholstery coatings, paints, sealants, and varnishes, etc.
  • Workplaces such as factories and manufacturing facilities using PFAS
  • Makeup and cosmetic products
  • AFFF firefighting foam

PFAS is known as the “forever” chemical because it does not break down and accumulates over time — including in the human body. In fact, scientists have been unable to estimate a PFAS “half life,” or, the amount of time it takes for a chemical to degrade by 50 percent.

PFAS Cancer Risk

Despite their widespread use in manufacturing and other industries, PFAS chemicals are extremely toxic and known to cause cancer.

PFAS has been designated as a “possible human carcinogen” by the International Agency for Research on Cancer (IARC) since 2017. The chemical has been linked to various types of cancer, including kidney cancer, testicular cancer, ovarian cancer, prostate cancer, non-Hodgkins lymphoma, thyroid cancer, and leukemia.

Other scientific organizations, including the EPA, have warned that exposure to PFAS can cause adverse health effects, potentially including cancer. The U.S. Agency for Toxic Substances and Disease Registry (ATSDR), a division of the Centers for Disease Control and Prevention (CDC), has reported that PFAS may cause kidney cancer and testicular cancer.

Separately, a landmark 2021 study in the Journal of Environmental Research reviewing research to date determined that “The cancer sites with the most evidence of an association with PFAS are testicular and kidney cancer. There are also some suggestions in a few studies of an association with prostate cancer.”

Military Bases and PFAS Groundwater Contamination

Military bases have been identified as significant sources of PFAS contamination, particularly in groundwater, due to the extensive use of aqueous film-forming foam (AFFF) used in firefighting training exercises and emergency response. AFFF contains high levels of PFAS, and its repeated use has led to widespread contamination in areas surrounding military installations. The strong connection between military bases and PFAS groundwater contamination has resulted in health and environmental concerns for nearby communities, who are often exposed to these hazardous chemicals through drinking water.

For example, PFAS contamination at Marine Corps Base Camp Lejeune in North Carolina (just down the road from Riddle & Brantley's offices in Jacksonville, NC) has been linked to several cases of cancer and other serious health conditions in both military personnel and their families. Similarly, Peterson Air Force Base in Colorado and Naval Air Station Fallon in Nevada have been focal points of PFAS contamination, with extensive clean-up efforts underway to address the severe environmental impact.

High-Profile PFAS Spills at Military Bases

  • Marine Corps Base Camp Lejeune, NC: PFAS contamination from AFFF and other sources was linked to serious health issues among residents.
  • Peterson Air Force Base, CO: Groundwater contamination affected surrounding communities, sparking lawsuits and remediation efforts.
  • Naval Air Station Fallon, NV: Significant PFAS contamination from firefighting foam, impacting local water sources.
  • Wurtsmith Air Force Base, MI: One of the most contaminated sites in the U.S., with ongoing groundwater pollution concerns, including PFAS contamination.
  • Eielson Air Force Base, AK: High levels of PFAS found in drinking water sources, leading to public health advisories.

These are simply examples. As research continues, we anticipate that many more US military bases and associated AFFF and other chemical runoff may be linked to PFAS groundwater contamination in surrounding communities. We are actively investigating these cases. Please call 1-800-525-7111 for a FREE case review to see if you may qualify for a PFAS lawsuit.

Industrial Sites and PFAS Groundwater Contamination

Industrial sites, particularly those involved in manufacturing and processing chemicals, plastics, and textiles, are major contributors to PFAS contamination in groundwater. Facilities that produce or use PFAS in their products often discharge these toxic substances into local water supplies, potentially impacting surrounding communities. Due to the persistence and mobility of PFAS in the environment, contamination can spread far beyond the initial industrial source, posing a significant health risk to residents in nearby areas.

For instance, the Saint-Gobain Performance Plastics plant in Merrimack, New Hampshire, was linked to widespread PFAS contamination affecting thousands of residents. Similarly, 3M's plant in Decatur, Alabama, is allegedly linked to PFAS pollution in the Tennessee River, which serves as a water source for local communities. These industrial sources of PFAS have prompted legal action, regulatory scrutiny, and efforts to improve water safety standards.

High-Profile PFAS Contamination at Industrial Sites

  • Saint-Gobain Performance Plastics, NH: Significant PFAS contamination impacting private wells and municipal water systems.
  • 3M Plant, Decatur, AL: PFAS discharge into the Tennessee River, leading to lawsuits and remediation efforts.
  • Chemours Plant, Fayetteville, NC: PFAS from manufacturing processes found in the Cape Fear River, affecting downstream water supplies.
  • DuPont, Parkersburg, WV: Contamination from PFAS used in Teflon production, leading to a major class-action lawsuit.
  • Tyco Fire Products, Marinette, WI: PFAS contamination from AFFF manufacturing, impacting local groundwater.

If you live in close proximity to a factory or industrial facility that may have leaked PFAS chemicals into nearby water sources, and were diagnosed with a qualifying cancer or health problem, call us today for a FREE case review. You may qualify for a PFAS lawsuit and be entitled to significant financial compensation.
