What Kind of Compensation Can You Expect from the 3M Earplug Lawsuit?

What is the Average Payout in the 3M Earplug Lawsuit - Riddle & BrantleyIf you served in the U.S. military and have now suffered hearing damage after wearing 3M earplugs, you may be entitled to compensation in a 3M earplug lawsuit.

3M earplug payouts are not guaranteed, and individual settlements will depend on the unique facts and circumstances of each case. In the case of a “global” 3M earplug settlements, claims will be divided into “tiers” based on the severity of injury and the significance of the claim.

3M Earplug Average Payouts

If 3M lawsuits result in a settlement (and there are no guarantees), the average payout for a 3M earplug claim will depend on a variety of factors such as:

  • The total final settlement amount
  • The severity of your injuries
  • The amount of proven damages you personally incurred

Payouts in Similar Product Liability Cases

While there are no guarantees and we cannot be certain that 3M earplug lawsuits will result in settlements, to get an idea of the kind of settlements we might reasonably anticipate, we can look at some examples of similar product liability and dangerous drug cases and their settlements.

Roundup

In a similar product liability mass tort action concerning allegations that Roundup caused non-Hodgkins lymphoma and other cancer, a global Roundup settlement was reached in mid-2020, totaling roughly $10 billion. While individual payouts are not guaranteed and may vary widely, the New York Times reported that plaintiffs might expect between $5,000 and $250,000, depending on the specific facts and circumstances of their case.

Talcum Powder

While there has not been a global settlement of thousands of talcum powder lawsuits alleging Johnson & Johnson talc-based baby powder caused cancer, individual cases have resulted in multi-million dollar jury awards. It is unlikely in a case involving as many plaintiffs as in 3M litigation — and lesser injuries compared to life-threatening and even deadly cancer — that verdicts or settlements will result in comparable compensation, but talcum powder lawsuits reveal just how seriously judges and juries are taking defective product claims.

“Why is there a 3M earplug lawsuit?”

3M Earplug Lawsuits - Riddle & BrantleyIn 2016, a rival earplug manufacturer, Molden-Metric, filed a whistleblower suit alleging that 3M and the original manufacturer of Combat Arms earplugs, Aearo Technologies, knew that there was a design flaw in their earplugs that could cause hearing damage in the wearer if worn incorrectly.

These earplugs allegedly have a design flaw that causes them to loosen without the wearer noticing and allow damaging loud sounds in (for example, explosions and gunshots). This can cause severe hearing damage in the wearer and result in long-term hearing problems such as tinnitus.

In 2018, 3M settled this lawsuit with the Department of Justice for $9.1 million, but did not admit any fault or liability in the damage done to service members hearing.

Now, the service members who have suffered hearing loss during their time in the U.S. military have filed thousands of 3M lawsuits to attempt to collect damages from 3M for its alleged negligence in distributing faulty earplugs.
