Bayer Asks U.S. Supreme Court to Block Roundup Lawsuits

A Major Development in the Roundup Litigation

Bayer, the manufacturer of the weedkiller Roundup, has asked the United States Supreme Court to block thousands of lawsuits that claim the company failed to warn consumers about cancer risks linked to the herbicide. This development marks another chapter in the ongoing legal battles surrounding Roundup’s active ingredient, glyphosate, and its alleged connection to non-Hodgkin’s lymphoma and other cancers.

The Supreme Court filing follows a Missouri case in which a jury awarded $1.25 million to a man who developed non-Hodgkin’s lymphoma after using Roundup in a community garden. Plaintiffs in Roundup lawsuits argue that Bayer, which acquired Monsanto (the original maker of Roundup), failed to provide adequate warnings about the potential cancer risks of glyphosate exposure.

Bayer has strongly denied any liability and/or wrongdoing in these cases.

Bayer’s Argument to the Supreme Court

Bayer contends that federal law, specifically the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), preempts state law claims that the company should have added cancer warnings to its product labels. Because the Environmental Protection Agency (EPA) has not required a cancer warning for glyphosate, Bayer argues that it should not be penalized under state law for failing to include one.

The company maintains that if juries in different states are allowed to decide whether Roundup should have included a cancer warning, it could create inconsistent labeling requirements across the country. This, Bayer argues, would conflict with federal regulations and create an unworkable legal standard for pesticide manufacturers.

The Supreme Court's decision on whether to hear the case could have a sweeping impact on the future of Roundup litigation. As of April 2025, more than 50,000 lawsuits are still pending against Bayer related to Roundup exposure and cancer claims. Although Bayer has settled many claims — committing more than $10 billion to resolve existing lawsuits — it continues to face new cases.

If the Court agrees with Bayer and rules that federal pesticide law overrides state warning requirements, it could shut down tens of thousands of claims currently pending in courts across the country.

Consumer advocacy groups and attorneys for plaintiffs argue that companies like Bayer should not be shielded from liability when they fail to warn consumers about known or suspected health risks. They note that juries have repeatedly sided with victims in trials, awarding both compensatory and punitive damages in multiple high-profile cases.

Who Qualifies for a Roundup Lawsuit?

If you or a loved one has been diagnosed with non-Hodgkin’s lymphoma (NHL) or chronic lymphocytic leukemia (CLL) after exposure to Roundup, you may be eligible to file a lawsuit.

  • Your exposure to Roundup occurred at least 2 years prior to diagnosis

  • In death cases, the date of death must be within the last ten years
