We were retained almost a year after a two-vehicle collision where the investigating officer
determined that our vehicle was the at-fault vehicle. Although we were retained late, we quickly secured an expert accident reconstructionist and a federal motor vehicle safety expert and located the vehicles. We had the data from the vehicles downloaded. We determined that we believed we could prove that although the driver of our vehicle may have been stalled in the highway, the driver of the other vehicle and his employer
also shared responsibility for the wreck. We filed suit and were able to
resolve the claim at mediation under the terms of a confidential settlement.
While we were able to successfully resolve this claim, it is important to note that
evidence can quickly disappear after a collision and
it is important to act quickly to retain an attorney following a collision. An officer’s determination as to how an accident occurred is not necessarily conclusive or always correct. Witnesses to the accident are vital to proving what happened. We secured the witnesses in this case even though months had passed.
