Bayer Scores First Roundup Jury Trial Win After Other Losses Bayer Scores First Roundup Jury Trial WinThe saga continues. Roundup manufacturer Monsanto (now known as Bayer AG following an acquisition) scored its first Roundup lawsuit trial win on October 5 when a jury ruled that Roundup herbicide was not a "substantial cause" of the plaintiff's non-Hodgkins lymphoma. Bayer has previously lost three jury trials involving Roundup lawsuits. In 2020, Bayer agreed to a global settlement totaling more than $10 billion. Thousands of plaintiffs in the Roundup multidistrict litigation (MDL) agreed to the settlement, but many have refused to sign on. In July 2021, Bayer announced it was setting aside an additional $4.5 billion in anticipation of potential future settlements and legal costs. IMPORTANT: While most Roundup lawsuits have already settled (or are in settlement negotiations), there is still time to file a Roundup claim provided the case meets certain criteria. 4th Roundup Jury Trial: a Win for Bayer

Bayer's first Roundup trial win played out similarly to other Roundup lawsuits with the exception of the outcome. Plaintiff Destiny Clark had alleged that her son Ezra's developed a rare disease called Burkitt's lymphoma — a form of non-Hodgkins lymphoma — after exposure to Roundup. Roundup, which contains an active and controversial ingredient called glyphosate, had  been sprayed on weeds at the family's residence. The lawsuit alleged that Monsanto (Bayer) was liable for the cancer and sought significant damages. Nevertheless, a jury disagreed with Clark and ruled in favor of Bayer. Following the trial, Bayer once again stood by its product and denied any liability or wrongdoing. "While we have great sympathy for Ezra Clark and his family, the jury carefully considered the science applicable to this case and determined that Roundup was not the cause of his illness," the company said in a statement. An attorney for Clark announced that they are considering an appeal. "We're disappointed for the boy and his family," said plaintiff's attorney Fletcher Trammel.

Bayer has now lost three of four jury trials, and the scientific community has largely supported claims that glyphosate in Roundup may cause cancer.
"Despite the recent verdict for Bayer, we remain committed to fighting for potential victims of Roundup exposure and are confident that justice will be served."
