Bayer Hit with $1.56 Billion Roundup Verdict
Verdict is a Massive Loss for Bayer
In a pivotal legal development, Bayer faces a staggering $1.56 billion verdict in Roundup litigation following a trial loss in Missouri over its Roundup weedkiller. This judgment is significant as four plaintiffs successfully argued that Roundup caused them injuries, including cancer. Specifically, the jury found Bayer’s Monsanto unit guilty of negligence, design flaws, and failing to adequately warn about Roundup’s potential dangers.
The plaintiffs, hailing from New York and California, were awarded a combined $61.1 million in compensatory damages, with each receiving $500 million in punitive damages. Their cases were centered around diagnoses of non-Hodgkin lymphoma, which they attributed to using Roundup. Additionally, one plaintiff’s spouse was awarded $100,000, citing harm due to her husband’s illness.
“This is a major win for victims of Roundup and we are committed to holding Bayer accountable.”
–Gene Riddle, Roundup lawsuit attorney
The Future of Roundup Lawsuits
This ruling might intensify the pressure on Bayer to revamp its legal approach, especially since the punitive damages may be reduced on appeal as they surpass U.S. Supreme Court guidelines. Bayer maintains its stance, asserting that extensive studies over the years have proven Roundup’s safety and that of its key ingredient, glyphosate, for human usage. Despite this, Bayer has experienced four consecutive legal defeats following nine trials where it was not found liable.
Notably, Bayer, in 2020, resolved most Roundup cases by agreeing to a settlement of up to $10.9 billion. However, about 50,000 claims are still pending from roughly 165,000 Roundup lawsuits filed against the company. These are primarily personal injury claims linked to Roundup, a product Bayer acquired through its $63 billion purchase of Monsanto in 2018.
