“Do I really need a VA disability lawyer?”
You are not required to hire a veterans benefits lawyer to assist with your VA disability appeal, however, statistics show that you are far more likely to get approved with the help of an attorney.
According to a 2017 report by the Department of Veterans Affairs (VA), those who appealed without representation were approved just 24 percent of the time, while those who appealed with representation by a VA disability lawyer were approved roughly 40 percent of the time.
That’s a big difference. You don’t want to gamble with your potential benefits.
Veterans disability payments can help pay for expensive medical bills and make up for lost income associated with your service-related disability.

Veterans disability benefits are available for any U.S. military veteran who has suffered at least partial disability due to an injury or illness incurred during their service.
In general, you may qualify for VA disability benefits if:
- You served in active duty, active duty for training, or inactive duty for training
- You suffered at least partial disability as a result of a service-related injury or illness
- You received a discharge other than dishonorable
You must also provide the following in order to be eligible for benefits:
- Medical evidence supporting your disability (this is in the form of a “Compensation & Pension” or “C&P” examination)

How the VA Disability System Works
The VA disability system can be complicated. The VA relies upon a series of stringent criteria in evaluating claims.
When evaluating your claim, the VA will assign you with a VA disability rating that is correspondent to your level of disability as determined by the VA. A disability rating is a percentage in increments of 10 such as 10%, 20%, 80% or 100%.
The amount of your monthly disability payment depends on your disability rating.
For instance, according to the VA’s most recently updated compensation tables:
- A veteran with a 10% disability rating will receive $142.29 per month
- A veteran with a 70% disability rating will receive $1,426.17 per month
- A veteran with a 100% disability rating will receive $3,106.04 per month
You may also receive a higher amount of disability if you are married and/or have dependent children.
IMPORTANT: In many cases, the VA disability you are assigned does not accurately reflect your true level of disability. In these situations, a VA disability attorney with experience in Fuquay-Varina can help file an appeal or new claim seeking a higher rating.
