Riddle & Brantley Secures $250K for Woman Injured in a Motorcycle Accident
The settlement below is intended to illustrate the type of matters handled by our firm. This result does not guarantee a similar outcome, and should not be construed to constitute a promise or guarantee of a particular result in any particular case. Every case is different, and the outcome of any case depends upon a variety of factors unique to that case.
In late 2016, our client was riding on the back of her friend’s motorcycle when it flipped unexpectedly, throwing her from the bike and causing severe injuries including a broken clavicle, fractured sternum, and fractured vertebrae. Initially, the driver of the motorcycle claimed that they were struck by another vehicle causing the accident. During the initial investigation, the “other vehicle” was never found and to make things more difficult, our client suffered a concussion and was unable to recall the details of the crash.
As the case progressed, more details were recovered that added complications. The driver of the motorcycle tested positive for alcohol when checked into the emergency room which initially caused the insurance carrier to deny coverage of the claim as well as liability siting assumption of risk for riding on a vehicle with a drunk driver.
After an extensive litigation process, the insurance company of motorcycle driver tendered $30,000 in insurance coverage.
Due to the extent of our client’s injuries, our team didn’t stop there. We pursue an underinsured motorist claim against another insurance carrier. While this was difficult at first and initially denied, we were able to recover a fair settlement with the help of the client’s mother and through litigation. The insurance company finally tendered their coverage which included an additional $220,000.
The effort from Smith and his team allowed our client to recover a total of $250,000 in compensation for her injuries.
