There is no shame in seeking disability benefits. You’ve paid into the system your entire life and you deserve the benefits you’re entitled to.
“I’ve already been denied Social Security disability benefits. What are my options?”
If you’ve been denied disability benefits by the Social Security Administration (SSA), don’t be discouraged. The reality is that most initial applications for disability are denied. In fact, recent statistics show that roughly 70 percent of initial disability claims are denied.
You have many options to appeal a denial.
There are many “levels” of appeal that you and a disability lawyer serving clients in Hope Mills can pursue. These include:
- “Reconsideration” level — If you are denied at the Initial Application level, you can file a “Request for Reconsideration” and your claim will be reviewed by a different Claims Examiner. Although only 13 percent or so of denials are reversed at this stage, you have the option to request a hearing with an Administrative Law Judge (ALJ).
- “Hearing” level — You may file a Request for Hearing with an Administrative Law Judge if your claim is denied at the Reconsideration level. At your hearing, your disability lawyer can present medical records and evidence before the ALJ and even cross-examine important witnesses. Many denials are reversed at this stage — roughly 47 percent.
- “Appeals Council” level — If your claim is also denied by the ALJ, you can file a request for consideration by the Appeals Council. The Council does not frequently award benefits itself, but roughly 9 percent of the time it will send your claim back to the ALJ for further consideration.
- Federal Court level — If your claim is still denied by the Appeals Council, your disability lawyer with experience in Hope Mills NC can file a lawsuit in Federal District Court. Federal District Courts only reverse denials roughly 2 percent of the time, but they often will remand cases back to the ALJ for further consideration after uncovering errors or discrepancies.
In rare cases, a disability claim denial may be appealed before the United States Circuit Court of Appeals. However, these cases are extremely complex and most claimants do not pursue this course of action.
