Zantac Lawsuit Update - Late 2021

Zantac Lawsuit UpdateWith thousands of lawsuits being filed, Zantac cases were consolidated into multi-district litigation (MDL) in the Southern District of Florida in February 2020. The first "bellwether" trial has been scheduled for October 10, 2022 in southern California. Bellwether trials are important in MDLs because they are used to weigh the evidence for and against claims. The outcome of the first Zantac bellwether trials in late 2022 will likely influence the defense's willingness to engage in settlement negotiations, as well as the size of any potential settlements.

Important Zantac Lawsuit Updates as of Late 2021:

  • Zantac lawsuits have been consolidated into multi-district litigation (MDL) to streamline the legal process
  • Judge Robin Rosenberg is overseeing the MDL in US District Court for the Southern District of Florida
  • Thousands of lawsuits have been filed and legal analysts anticipate thousands more
  • Defendants, including brand-name Zantac manufacturers GlaxoSmithKline (GSK) and Sanofi continue to deny any liability, negligence, and/or wrongdoing, and no settlements have been agreed to
  • The first Zantac "bellwether" trial is scheduled to start October 10, 2022 in southern California

“What is the Zantac MDL and how does it work?”

An MDL is a legal mechanism for combining multiple, similar claims in order to expedite litigation. In the Zantac MDL, each plaintiff’s case remains separate, and plaintiffs are represented by their own attorneys. In the event of a global settlement, plaintiffs’ cases will be evaluated separately and awarded compensation, often based on a “tier” determined by his or her injuries and the strength of his or her claim. U.S. District Judge Robin Rosenberg is overseeing the MDL and has determined that the first trial will begin in October 2022. She has appointed 26 lawyers as co-lead counsel who will be charged with spearheading the litigation on behalf of plaintiffs in the MDL. IMPORTANT: For the latest court filings and trial updates, please visit the US District Court for the Southern District of Florida's Zantac MDL website. Even though the MDL is based in Florida, victims of cancer potentially caused by Zantac may be eligible to join the litigation from across the United States. What is Zantac?

Zantac is one of the world’s most commonly prescribed medication for treating heartburn, otherwise known as gastroesophageal reflux disease (GERD). It has been on the market in the United States since 1983 and millions have been exposed. Zantac is available in both prescription and over-the-counter forms, and a generic (ranitidine) is also available. Manufacturers of Zantac and generic ranitidine include:
  • Sanofi
  • Boehringer
  • Ingelheim
  • GlaxoSmithKline (GSK)
  • Amneal Pharmaceuticals
  • Apotex Corp.
  • Sandoz
These Zantac manufacturers are currently being sued in relation to two primary allegations:
  • Defective design
  • Failure to warn consumers
***Disclaimer: No settlement agreement has been reached in any litigation regarding ranitidine (ZANTAC®), including in the Multidistrict Litigation in the United States District Court for the Southern District of Florida (case no. 20-MD-2924).

“Why are Zantac lawsuits being filed?”

In late 2019, an independent lab first discovered NDMA contamination in Zantac and generic ranitidine, findings that were later confirmed by the Food and Drug Administration (FDA). Zantac recalls were almost immediately issued, and popular pharmacies removed Zantac and ranitidine from their shelves. NDMA in Zantac represents a serious cancer risk. In fact, NDMA (N-Nitrosodimethylamine) is used in laboratories to cause cancer in rats and other animals. NDMA is classified as a “probable carcinogen,” meaning it may cause cancer in humans, by scientific organizations including the World Health Organization (WHO), the Centers for Disease Control and Prevention (CDC), and the Environmental Protection Agency (EPA).
